Refund Policy

Thank you for subscribing to the Kelly Simonz Official Fan Club application. Please read this refund policy carefully, as it outlines the terms and conditions for refunds related to your subscription. By purchasing a subscription on our app, you agree to be bound by the terms defined below.

Article 1 Definitions

  • Subscription: A recurring payment that provides access to premium features or content (e.g., ad-free usage or exclusive content) for a specific period (e.g., monthly or annually). Subscriptions automatically renew unless canceled before the end of the billing cycle.
  • Eligibility Window: The eligibility window for refunds refers to the period after a purchase during which a user can request a refund for in-app purchases, including both one-time purchases and subscriptions. This window is meant to give users time to evaluate their purchases and resolve any issues, such as accidental or unauthorized transactions.

Article 2 Refund Scope

This refunds policy does not cover the refunds for the purchases made in the SUZURI store linked to our application. For these refunds, please refer to SUZURI refund policies if you purchase from Japan or to WorldShopping if you purchase from outside Japan.

In principle, we do not offer refunds as you will still be able to use the service until the day before your renewal date.

Subscribing to our app subscription gives you immediately access to the content offered with this subscription. By consequence, by subscribing to a subscription you agree to lose your right of withdrawal and eligibility to a refund, with the exception of any eligible situations provided in this document, in the store’s policies from which you made the purchase, or in the consumer law of your country of residency.

Refunds apply only to the payment made for the current subscription period. Refunds for previous months or past subscription periods are not eligible.

Subscriptions refunded automatically cancel the subscription related to the refund request and any related benefits offered by this subscription.

Refund requests submitted to a 3rd party platform are processed in accordance with the policies of the platform used for the payment (Apple App Store or Google Play Store).

Article 3 Refund Process

Subscription payments are processed through Apple’s App Store and Google’s Play Store. Refund requests submitted to these platforms are governed by their respective policies based on users’ location.

Submitting a refund request for a subscription depends on the platform used to make the purchase and the time elapsed since the purchase.

  • Google Play Store subscriptions: Users have 48 hours from the time of purchase to request a refund. Requests need to be opened directly in Google Play Store.
  • Beyond 48 hours, refund requests can directly be addressed to us by using the contact details in the contact information section of this policy, and providing the reason behind the refund requested. Requests may still be submitted to Google Support, but they are not guaranteed.

  • Apple App Store subscriptions: Users can request refunds for eligible purchases within a reasonable period, depending on the region and type of transaction. Refunds may be considered beyond this period under exceptional circumstances. Refunds for subscriptions purchased on this platform are managed exclusively by Apple, and at their sole discretion. We cannot issue refunds directly.

We encourage users to review Apple’s App Store and Google’s Play Store policies to understand how they handle your refund requests.

Refunds requests submitted directly to our contact information are reviewed on a case to case basis, depending on the reason behind the refund requested and applicable laws.

Please note that for both situations a refund request is not guaranteed. Users are encouraged to provide supporting documentation when applicable.

Article 4 Canceling Subscriptions

Canceling your subscription does not automatically result in a refund. Canceling only stops the auto-renewal for the next billing cycle.

The users can cancel their subscription from their devices by following the instructions below:

On iOS Devices:

  1. Open the Settings app and tap your name.
  2. Go to Subscriptions.
  3. Find and select the subscription you wish to cancel, then tap Cancel Subscription.

On Android Devices:

  1. Open the Google Play Store app.
  2. Tap your profile icon, then go to Payments & subscriptions > Subscriptions.
  3. Select the subscription you want to cancel and tap Cancel Subscription.

Article 5 Legal Compliance

This refund policy is governed by the laws and regulations of Japan, including applicable consumer protection laws, including the Consumer Contract Act, the Act on Specified Commercial Transactions and the Act on the Protection of Personal Information. For users residing outside of Japan, this policy will comply with relevant local laws where required (e.g. California Consumer Privacy Act, the Federal Trade Commission Regulations, the Consumer Rights Directive, the General Data Protection Regulation).

Your statutory rights, including any rights you may have under consumer protection laws, are not affected by this refund policy.

Article 6 Refunds for Exceptional Circumstances

Refund requests for exceptional circumstances, such as accidental or unauthorized purchases, are reviewed on a case-by-case basis by the respective platform (Apple App Store or Google Play Store).

Users are encouraged to provide supporting documentation when applicable.

Article 8 Changes to the Refund Policy

This refund policy may be updated periodically to reflect changes in our services, platform policies, or applicable laws. Any significant changes will be communicated through the app or our website. Information related to 3rd party platforms provided in this documentation can be modified by the 3rd party without being immediately updated in this document. Please always refer to the 3rd party documentation.
